Understanding Polish VAT (PTU)

In Poland, value-added tax is officially called **podatek od towarów i usług** (**PTU**), but is universally referred to as **VAT**. The Ministry of Finance (Ministerstwo Finansów) manages the VAT registers, tax collection, and compliance tools.

2026 VAT Registration Threshold Increase (240,000 PLN)

Effective **1 January 2026**, Poland raised its VAT registration exemption threshold (podmiotowe zwolnienie z VAT) from 200,000 PLN to **240,000 PLN** of annual sales turnover. Sole proprietors (Jednoosobowa Działalność Gospodarcza - JDG) and small firms whose sales remain below 240,000 PLN in the preceding and current fiscal years are exempt from charging VAT, provided they do not sell goods or services excluded from the exemption (such as jewelry, cosmetics, electronics, or legal counseling).

Mandatory Electronic Invoicing: KSeF Timelines for 2026

The National System of e-Invoices (**Krajowy System e-Faktur - KSeF**) introduces mandatory structured electronic invoicing for all commercial B2B transactions in Poland. The phased implementation deadlines are set as follows:

  • 1 February 2026: Mandatory for large enterprises (companies with an annual sales turnover exceeding **200 million PLN** in the previous calendar year).
  • 1 April 2026: Mandatory for all other active VAT taxpayers, including small and medium-sized enterprises (SMEs) and sole proprietors.

All structured invoices must be issued in XML format and uploaded directly to the central KSeF platform for real-time validation.

Polish Invoice Requirements (Wymogi Faktury VAT)

Under Polish VAT Act (Ustawa o podatku od towarów i usług), every VAT invoice must contain mandatory elements. Missing items invalidate input VAT deduction:

  • Full names & addresses of seller (sprzedawca) and buyer (nabywca)
  • NIP (Tax ID) of both parties; for EU B2B — both VAT-EU numbers (PL + country prefix)
  • Sequential invoice number (unique within series)
  • Date of issue (data wystawienia) and date of supply (data sprzedaży/dostawy) if different
  • Description of goods/services with quantity (ilość) and unit (j.m.)
  • Unit price netto, any discounts/rebates (zniżki/rabaty)
  • Net value (wartość netto) per VAT rate (23%, 8%, 5%, 0%, zw, np)
  • VAT rate per line, VAT amount (kwota VAT), and total VAT
  • Total amount due (kwota do zapłaty) = netto + VAT
  • For reverse charge: "odwrotne obciążenie" + legal basis (e.g., Art. 17 ust. 1 ustawy o VAT)
  • For zwolnienie (exempt): "zw" + legal basis (e.g., Art. 43 ust. 1 pkt 7)

Simplified invoices (faktury uproszczone) up to 450 PLN / 100 EUR: fewer details but must show seller, buyer NIP, date, description, total brutto, VAT rate.

JPK_VAT & KSeF: Filing & E-Invoicing 2026

JPK_VAT (SAF-T): Monthly XML file combining VAT return + detailed transaction lines. Due by 25th of following month. Small taxpayers (under 1.2M EUR turnover) may opt for quarterly.

KSeF (National e-Invoice System) — Mandatory from 2026:

  • 1 Feb 2026: Large enterprises (over 200M PLN turnover in 2024)
  • 1 Apr 2026: All other active VAT taxpayers (SMEs, JDG)
  • Invoices issued as structured XML (FA(2) schema) via KSeF API or MF e-Faktury app
  • Real-time validation — invoice gets KSeF reference number (numer KSeF)
  • Offline mode: 48h to upload after connection restored
  • Penalties: Up to 100% of VAT on non-compliant invoices

Excluded from 240,000 PLN Exemption (Produkty/Usługi Wyłączone)

Even with turnover under 240,000 PLN, you must register for VAT from first sale if you supply:

  • Precious metals, jewelry, gemstones (PKWIU 32.12, 24.41)
  • Cosmetics & perfumery (PKWIU 20.42)
  • Electronics: computers, phones, tablets, TVs, cameras (PKWIU 26.x)
  • Motor vehicles, motorcycles, parts (PKWIU 29.x, 30.x)
  • Legal, tax advisory, accounting services (PKWIU 69.10, 69.20)
  • Building land, new residential buildings (PKWIU 41.10, 41.20)
  • Goods subject to excise (alcohol, tobacco, fuels, electricity)

Check full list in Art. 113 ust. 13 ustawy o VAT and załącznik nr 3.

Reverse Charge (Odwrotne Obciążenie) in Poland

Mandatory domestic reverse charge for specified goods/services (Art. 17 ust. 1 ustawy o VAT):

  • Electronics: processors, laptops, tablets, phones, game consoles (Annex 11)
  • Steel products, non-ferrous metals, metal waste (Annex 11)
  • Construction services (building, renovation, demolition) between VAT taxpayers
  • Greenhouse gas emission allowances
  • Precious metals (gold, silver, platinum)

Cross-border EU B2B: 0% VAT, invoice "odwrotne obciążenie — Art. 28b ustawy", both VAT-EU numbers required. Buyer self-assesses in Polish JPK_VAT.

Penalties & Enforcement (2026)

  • Late JPK_VAT: 500–2,500 PLN per month of delay (capped at 10,000 PLN per return)
  • Late VAT payment: Interest (odsetki zwłokowe) ~11.25%/year + 10% surcharge after demand (wezwanie)
  • KSeF non-compliance: Up to 100% of VAT on invoices not issued via KSeF when mandatory
  • Incorrect VAT return: 30% of underpaid tax (negligence) up to 100% (intent)
  • Missing NIP/VAT-EU on invoice: Buyer loses deduction right; seller fined per invoice
  • White List (Biała Lista) check failure: Payment to non-listed account = no VAT deduction + no tax cost deduction

Split Payment Mechanism (MPP — Mechanizm Podzielonej Płatności)

Mandatory for B2B invoices over 15,000 PLN brutto for sensitive goods/services (Annex 15: steel, electronics, fuels, construction, scrap, waste). VAT portion goes to buyer's VAT account (rachunek VAT) — cannot be used for other payments.

Polish VAT Calculation Formulas

Our calculator applies the following equations:

Add 23% VAT (Net to Gross)

Mathematical Formula
Formula: Gross = Net × (1 + VAT Rate)
Worked Calculation
VAT Amount = 1 000 zł × 0.23 = 230 zł
Worked Calculation
Gross Price = 1 000 zł + 230 zł = 1 230 zł

Remove 23% VAT (Gross to Net)

Mathematical Formula
Formula: Net = Gross ÷ (1 + VAT Rate)
Worked Calculation
Net Price = 1 230 zł ÷ 1.23 = 1 000 zł
Worked Calculation
VAT Portion = 1 230 zł - 1 000 zł = 230 zł

Polish VAT rates and 2026 threshold updates

Poland charges a standard VAT rate of 23%, with reduced rates of 8% and 5%. The VAT registration threshold is set at 240,000 PLN for 2026. This calculator automatically incorporates these values.

JPK_VAT and KSeF compliance guide

Poland enforces JPK_VAT monthly XML reporting. In 2026, KSeF structured invoicing becomes mandatory in phases: 1 February 2026 for large enterprises, and 1 April 2026 for SMEs and JDGs.

Frequently asked questions

Quick answers to the most common questions users ask.

What is the standard Polish VAT rate in 2026?

The standard VAT rate in Poland is 23%. Reduced rates are 8% (intermediate) for hospitality, hotel stays, renovations, and 5% (reduced) for books and basic agricultural foodstuffs.

How do I remove Polish VAT (PTU) from a gross price?

To remove the standard 23% VAT from a gross price, divide the total by 1.23. For example, 1,230 zł gross divided by 1.23 equals 1,000 zł net, with 230 zł being the VAT amount. For the 8% rate, divide by 1.08, and for 5%, divide by 1.05.

What is the Polish VAT registration threshold for 2026?

Effective 1 January 2026, Poland raised its VAT registration exemption threshold to 240,000 PLN (previously 200,000 PLN). Small firms and sole proprietors (JDG) with sales under 240,000 PLN can be exempt from VAT.

Which products/services are excluded from the 240,000 PLN Polish VAT exemption?

The VAT exemption threshold does not apply to certain business activities. Businesses selling electronics, cosmetics, jewelry, legal advice, consulting, or tax services must register for VAT from their first sale, regardless of turnover.

What are the KSeF implementation deadlines in Poland for 2026?

The Krajowy System e-Faktur (KSeF) mandatory structured invoicing timelines are: 1 February 2026 for large companies (sales turnover > 200 million PLN in 2024), and 1 April 2026 for all other VAT-registered taxpayers.

What is the JPK_VAT requirement in Poland?

Poland requires all active VAT taxpayers to submit a JPK_VAT file (SAF-T format) electronically each month. The file combines your VAT return declarations with detailed transaction logs of sales and purchases.

How does the reverse charge (odwrotne obciążenie) work in Poland?

For cross-border EU B2B sales, the Polish seller invoices without VAT and the EU business buyer self-assesses the tax on their return. Domestically, reverse charge applies to specific items like electronic goods, metal wastes, and emissions trading under special conditions.

What are the penalties for non-compliance with KSeF in Poland?

Failing to issue a structured invoice through the KSeF platform when required, or issuing an invoice during offline periods without uploading it later, can result in severe financial penalties of up to 100% of the VAT amount shown on the invoice.

Can a foreign business register for VAT in Poland?

Yes. Foreign businesses selling goods stored in Polish warehouses or importing items to sell to Polish consumers must register for VAT. Non-resident firms do not qualify for the 240,000 PLN exemption limit.
