The Responsible Party Signs Up for Something Real

  1. Confirm nexus and fix the date it began. Establish that you genuinely have nexus in the state and identify the date it arose. That date, not the date you apply, determines whether back periods exist.
  2. Evaluate back exposure before applying. If the obligation began materially in the past, assess the historic liability first. Registering with a backdated effective date surfaces it, and a voluntary disclosure agreement may produce a better outcome than a straightforward registration.
